Welcome to the Manufactured Housing Division

The Manufactured Housing Division under the Manufactured Housing Act and Administrative Code is the inspection authority for manufactured housing in New Mexico.

Our mission is to foster a strong manufactured housing industry and provide consumer protection for manufactured housing owners in New Mexico by:

  • Providing thorough inspections of manufactured housing installations and alterations
  • Working with industry contractors through outreach and news publications
  • Working with manufacturers through construction process monitoring
  • Working with dealers through auditing and inspections of homes
  • Working with the Manufactured Housing Committee on rules and regulations

Rule Hearings

The Manufactured Housing Division will convene a public hearing for the amendment of 14.12.9 NMAC-INSPECTIONS. The hearing will be held before a hearing officer, at which time any interested person is invited to submit data, views, or arguments on the proposed changes, either orally or in writing, and to examine witnesses testifying at the hearing. The hearing is scheduled for Tuesday, September 24, 2024.

The purpose of this public rule hearing is to receive public comments regarding the amendments to 14.12.9 NMAC. Amendments clarify requirements for licensees to correct code violations, pay for re-inspection fees and request inspections.  The amendments also delete outdated requirements for posting permits and licensing requirements incorrectly placed under this section.

The statutory authority for this rulemaking is found in the New Mexico Manufactured Housing Act, Subsection D of Section 60-14-4 NMSA 1978.

Proposed Rule Changes

PSI Update - November 14, 2023

Effective December 15, 2023, the processing of all MHD renewals and other licensing paperwork (status changes, new dealer/broker applications, etc.) will be transferred to PSI. Permitting and inspections will continue to be handled by the RLD.

 

From this date (December15) forward, please send all renewals to PSI at 2820 Broadbent PKWY NE, Ste F, Albuquerque, NM, 87107. Please make all checks payable to PSI.

 

Our office is open Monday through Friday, at the Broadbent location. We provide an initial scan for obvious errors at the window, extended business hours on Tuesdays and Thursdays, and have a notary available upon request. Hours are as outlined below:
M-W-F8-5 Tues-Thurs 8-7

 

For your increased convenience, licensing fees will now be able to be paid by credit card, in addition to check or money order.
Additionally, the expiration date of all licenses will be extended to the end of the month.

 

ex. If your license previously expired on January 23, it will now expire on January 31. If it were previously February 4, it will now expire on February 28.

Enforcement Actions

Contracting without a license in New Mexico is against the law. If a contractor is working without a license, the Division may stop the construction project and file a criminal charge of unlicensed contracting in Metropolitan or Magistrate Court. Violators will be eligible for licensure 1 year from date of conviction.

Any one engaged in construction-related contracting in New Mexico must be licensed. This includes general construction work, electrical, mechanical and plumbing and LP gas. The activities that are considered to be contracting in New Mexico are defined in the Construction Industries Licensing Act, NMSA 1978,
Section 60-13-3.

**A military service member or veteran as defined in NMAC 14.12.10.8 shall not be charged a licensing fee for the first 3 years a license issued under those rules is valid.**

Contractors and journeymen licensed by the Construction Industries Division performing work on manufactured homes shall be registered with the Manufactured Housing Division and pay an annual registration fee of $100 per license and post with MHD an installer’s or repairer’s consumer protection bond, pursuant to NMAC 14.12.4.13.

LATE FEES

Each license shall be renewed annually during its anniversary month. The division shall mail a renewal notice to each current licensee at least 30 days prior to the expiration date of the license.

 

Renewal notices will be mailed to the last known address on file with the division. It is the responsibility of the licensee to keep the division informed of any changes in address.

 

The licensee is responsible for renewing his license. Failure to receive the renewal notice shall not relieve the licensee of the responsibility of renewing his license before the expiration date.

 

The division shall allow a 30-day grace period after a license has expired for a licensee to renew without penalty. After the 30-day grace period the licensee must pay a late renewal fee equal to one dollar ($1.00) for each day, up to 30 days, that has elapsed since the 30-day grace period and thereafter for a fee equal to twice the amount of the annual license fee.

 

If an account has been expired for longer than a year, then account needs to start over as new per NMAC 14.12.8.8.
